Man who drove into Rochester market now faces charges

ROCHESTER, Minn. (FOX 47) – Police have referred charges to Olmsted County prosecutors three months after a man crashed a car into a family-owned grocery store.

Capt. Casey Moilanen confirmed Tuesday that investigators referred charges of Felony Criminal Vehicular Operation to the Olmsted County Attorney’s Office. Charges against Justin Kelley, 32, had been pending while police waited for blood test results.

Police had previously reported Kelley was “probably” driving very fast along 40th Street NW when he missed a curve and hit a snow bank on Feb. 16. The car went airborne and into Saigon-Far East Oriental Market.

Police say Kelley smelled of alcohol at the scene. Kelley fractured his spine. Two passengers in the car also went to the hospital. The accident report indicated the group was headed back from a bar at the time of the crash.
