Former Rochester Public Schools employee sentenced for 5th Degree Criminal Sexual Conduct

ROCHESTER, Minn. (FOX 47) — A former Rochester Public Schools employee was sentenced Friday to serve 45 days in jail, after pleading guilty in May to a gross misdemeanor charge of 5th Degree Criminal Sexual Conduct.

Nicholas Keller, 31, had worked at the School Aged Childcare program at Sunset Terrace Elementary in Rochester for ten years.  He resigned in May of 2017 shortly after the allegations first surfaced.

Keller was sentenced to 365 days in jail but 320 days of it were “stayed” by Judge Pamela King for four years while he is on supervised probation.  The judge allowed Keller to be out on work release or on a Sentenced To Service crew three days a week.

Among the other conditions of the sentence, Keller is required to attend a sex offender program within 30 days of his release from custody, to have no contact with the victim or family, no contact with persons under age 18 unless approved in advance, and not to possess or use any pornographic or sexually explicit material.

Keller will be required to register as a predatory offender as of July 12, and to pay restitution of $400.  He must also perform 50 hours of community work service within the next year.

Back in 2017, an eight-year-old girl said Keller had touched her inappropriately while on school grounds.  Then months later, after the case against him went public, another woman then 21 said she had a similar experience years earlier.
